Weekend violence in Oakland: Is Occupy movement back, or broken? (+video)

Has the Occupy movement abandoned nonviolence??Oakland protesters and police issue contradictory accounts of clashes that led to hundreds of arrests and several injuries.?

The struggle to define the group?s actions is already playing out in?an escalating rhetorical war. On Monday, Oakland Mayor Jean Quan told the local CBS affiliate she planned to call ?some of the national leadership of Occupy this week to say that the Oakland group is not nonviolent,? with the hope that the larger group will distance itself.

At the same time, Occupy Oakland media team member Shake Anderson dismisses Quan?s charge, saying simply, ?We did not attack the police,?they attacked us.?

On Saturday, according to an Occupy Oakland statement, protesters began a series of actions attempting to put ?a vacant building to better use,? which Mr. Anderson acknowledges can be seen as trespassing. The site in question has been vacant for six years, according to the statement, which continues,?asserting that the Occupy group had voted to mount a nonviolent?action to turn the space into a social center and headquarters of Occupy Oakland.

The crowd?was met with an overwhelming police force, says Anderson, a force buttressed by mutual aid from 13 surrounding cities.

?We?did not throw anything, says Anderson.

However,?the Oakland Police Department (OPD), which describes?the events in its own release, said that as activists began to march, ?the first dispersal order was given as the crowd began destroying construction equipment and fencing.?

?Officers were pelted with bottles, metal pipe, rocks, spray cans, improvised explosive devices and burning flares,? the OPD release said, adding that police ?deployed smoke and tear gas.?

Anderson says simply, ?this is a lie.?

By the end of the evening, some 400 protesters?had been arrested and several?police officers treated for?injuries.

Rick Santorum's Daughter Hospitalized; Duggar Family Fills in For Candidate on Campaign Trail


Republican presidential hopeful Rick Santorum's daughter Bella, who suffers from a rare genetic disorder called Trisomy 18, was hospitalized over the weekend.

Santorum left the presidential campaign trail in Florida to be with his three-year-old daughter Bella, the youngest of the former U.S. Senator's seven children.

Bella was admitted to Children's Hospital of Philadelphia Saturday but has since made a "miraculous turnaround," according to sources close to the candidate.

Rick Santorum’s 20-year-old daughter, Liz, appeared on his behalf in Sarasota, Fla., giving a brief speech to a crowd of about 250 at an airplane hangar.

"My dad wishes he could be here today," she said, according to The Palm Beach Post. "My dad today is exercising his most important role; being a dad."

Santorum also received some help from supporters Jim Bob and Michelle Duggar of TLC's 19 Kids and Counting, who spoke at campaign events on his behalf.

The Florida primary is tomorrow.

Rick, who is lagging in polls behind Newt Gingrich and Mitt Romney, "intends to return to Florida and resume the campaign schedule as soon as possible."

Santorum often has spoken about how he never expected Bella to live to her first birthday, which would not be a stretch for a child born with Trisomy 18.

Trisomy 18 is a genetic disorder that kills about 90 percent of children before or during birth and those that do live past birth suffer serious symptoms.

Children with Trisomy 18 have an extra copy of chromosome 18, which causes symptoms like clenched hands, low birth weight and mental deficiency.

Here's wishing Bella, Rick, his wife Karen and all their children all the best in what has to be a tremendously difficult time for the Santorum family.

Jake Burton fights Cancer | Snowbroader.EU

In the span of just four months, snowboard industry giant Jake Burton and a team of oncologists have evidently turned the tables on a disease that threatened to take his life.

Back in September, the pioneering snowboarder released a memo to his worldwide employee base that started off, ?The bad news is that I have cancer.? But that ton-of-bricks opener was immediately followed by some relatively good news: ?[It's] as curable as it gets.?

What Burton faced was testicular cancer ? medically known as seminoma ? the same disease that cyclist Lance Armstrong battled and overcame. With early detection, the survival rate of affected men is greater than 95 percent. The average age of diagnosis is 40 years.

Burton, 57, began a three-month regimen of chemotherapy, a cellular-level treatment that often comes with severely debilitating side-effects. Earlier this month, he released an update stating, ?It appears that my cancer is toast.?

That doesn?t mean, however, that Burton is in the clear and back on the mountain, approaching his typical 100-days-per-year snowboarding season. According to his memo, he?s still facing possible radiation treatment and surgery down the road ? the removal of one or both testes is not uncommon ? and must stay on-point with periodic scans and observation. Still, he remains upbeat.

?I?m not stressing about it,? he wrote, adding that oncologist Steve Ades told him, ?Jake, you get your diploma.?

?As I transition from being a patient to being a survivor,? Burton said, ?I move on with enormous respect for both cancer ? and chemotherapy (how something so beneficial [can] be so simultaneously harmful). I am pretty much broken ? I have a lot of healing to do. But when I look at role models like Lance Armstrong, I know I have no excuses.?

LIVERPOOL, England - There was no crowing from Landon Donovan after he led his Everton side to victory over Clint Dempsey's Fulham in England's FA Cup.

After all, the U.S. teammates will be on the same side again soon enough.

Donovan set up both Everton goals in Friday night's 2-1 win but says Dempsey is still the American success story in this season's Premier League.

The former New England Revolution forward has scored 15 goals for Fulham since August and Donovan says "in my opinion, he's been one of the players of the season in the Premier League."

United States international Tim Howard was in goal for Everton and Donovan says the match was "a little bit of an American invasion."

RIM CEO Thorsten Heins clarifies comments on change, rejects Android speculation

Freshly anointed RIM CEO Thorsten Heins sat down with Crackberry this week to discuss his vision for the future of BlackBerry, his thoughts on Android and, most strikingly, his recent comments about maintaining the status quo. Shortly after his appointment, Heins issued a video address in which he implicitly claimed that RIM doesn't need an overhaul. "If we continue doing well what we're doing, I see no problems with us being in the top three players worldwide in the next years in wireless," the exec said. At the time, we and many other observers read this as a sign that the Heins era would look a lot like the Balsillie-Lazaridis era, but according to the new CEO, that's not the case. "I was talking about drastic or seismic changes," he clarified. "What I was trying to address was that there was some suggestion that RIM should be split up or should even be sold. My true belief is that RIM has the strength and the assets that we can really succeed in this market." Heins went on to claim that there's already "a lot of change" going on at the company -- citing the company's adoption of QNX as a prime example -- and that there's "no standstill at any moment here at RIM."

During the same sitdown, Heins also reiterated his belief that RIM shouldn't outsource its software needs to Android, because BlackBerry, in his view, is a hallmark of differentiation. "Just take a look where the Android OEMs are," Heins said. "Take a look at their recent announcements and what you will immediately see is there is just no room for differentiation because they are all the same." The exec acknowledged that RIM may be taking the road less traveled, but seemed confident in its ability to rise to the challenge -- even if there are some bumps along the way. "This is not baking cookies," Heins elaborated. "This is building high tech products. From time to time your aspirations and your development timelines hit some bumps in the road that were not foreseen."

Japan's Tepco set for $13 billion bailout: sources (Reuters)

TOKYO (Reuters) ? The owner of Japan's stricken nuclear reactor, Tokyo Electric Power Co, will agree to be taken over by the government in a near-$13 billion bailout, sources said on Thursday, even as the country debates the future of nuclear power.

The injection of 1 trillion yen ($12.8 billion) in public funds would effectively nationalize Tepco (9501.T), supplier of power to almost 45 million people including Tokyo residents, in one of the world's biggest bailouts outside the banking sector.

Tepco has been dragging its feet over a proposal for the state-backed Nuclear Damage Liability Facilitation Fund to take at least a two-thirds stake in the company, which has been swamped by liabilities associated with the earthquake and tsunami which ruined its Fukushima nuclear power plant in March.

"If the government has a two-thirds stake, they have a right to control management, so naturally, Tepco doesn't like that," said one source familiar with the matter.

Tepco's future as an independent firm has been in doubt since the disaster, which triggered the world's worst nuclear crisis in 25 years and left the utility with huge compensation payments, cleanup costs and rising fuel bills as public concerns over safety make it hard to restart other off-line reactors.

Its plight has become emblematic of problems facing Japan's entire nuclear power industry, much of which has been idled since the disaster while authorities work to regain some public trust in an industry that had provided a third of Japan's power.

Tepco's fate is also being watched for clues as to whether Japan will deregulate its system of monopolistic regional utilities that both generate and distribute electricity.

Tepco's share price soared on the news, jumping 8 percent in heavy trade to 219 yen.

Tepco, which together with the fund is drafting a business reconstruction plan to be unveiled in March, is also seeking about 1 trillion yen in additional bank loans, sources said.

Under the plan, the utility is expected to swing to profit in fiscal 2014 and resume issuing bonds two years later, the Nikkei business newspaper reported.

The plan calls for government control to end in six or seven years, the Nikkei added, though other reports have said it might last about a decade.

According to the plan, Tepco is expected to post a parent-only net loss of about 580 billion yen in the year ending March 31 and next fiscal year, followed by a net profit of 37.7 billion yen in fiscal 2013, largely on the sale of real estate, the Nikkei said. Tepco is also expected to generate a pretax profit of 159.1 billion yen in fiscal 2014, it added.

The projection for improved earnings is based on the assumption Tepco will increase household electricity rates by 10 percent in October and reduce fuel costs by restarting reactors at its Kashiwazaki-Kariwa nuclear plant in fiscal 2013 -- moves the utility will find difficult to execute, the daily said.

Tepco shareholders will need to approve an increase in its authorized share capital at an annual meeting in June before the nationalization plan could go ahead.

INDIANAPOLIS ? EARNINGS DROP: Insurer WellPoint Inc. said Wednesday it earned $335.3 million, or 96 cents per share, in the three months that ended Dec. 31. That's down from $548.8 million, or $1.40 per share, in the final quarter of 2010. The performance was below Wall Street expectations.

WHAT HAPPENED: WellPoint said it took a $50 million hit from a Northern California Medicare Advantage plan it has since discontinued.

2012 FORECAST: The insurer expects to earn at least $7.60 per share on about $62.1 billion in revenue. Analysts expect earnings of $7.76 per share on $63 billion in revenue, according to FactSet.

SNK's new Neo Geo: 20 retro classics in one modern handheld

We rubbed our eyes a little when they first landed on this fine looking specimen, just to make sure they weren't deceiving us. But no, this really does appear to be a new handheld Neo Geo. We've seen SNK make inspired controllers, bring its catalog to other platforms and even make handhelds before, but nothing like this. The iPhone-esque body and 4.3 inch screen house a D-pad, shoulder and front buttons while hiding 2GB of storage inside -- pre-loaded with 20 classic titles (yes Fatal Fury and League Bowling included, and all in English). There's also an SD slot which we really really hope is for more games, as well as an AV output for some good old big-screen action. Famicon Plaza claims it's a licensed product not yet in full production, so there's no whiff of availability just now. When it does finally land, we hope it's not at a 2012 equivalent of grandad's $600+ price tag.

Ex-Romanian dictator's gifts up for auction (AP)

BUCHAREST, Romania ? What did they give the dictator who had everything?

An African leopardskin or a silver dove ? a novel offering from the former Shah of Iran ? are just two examples of gifts received by Nicolae Ceausescu that will be auctioned off Thursday, on what would have been the late Romanian leader's 94th birthday.

The auction which is billed "the Golden Age" is a reference to the final years of Ceausescu's rule, when Communist Party officials painted a rosy picture of life in Romania, while, in reality, people struggled with food shortages, power outages and the dreaded Securitate secret police which kept tabs on the population of 23 million with an army of 760,000 informers.

Ceausescu, known as "the Genius of the Carpathians," was overthrown during the 1989 anti-communist uprising and executed with his wife Elena after a summary trial on Christmas Day, 1989.

"This auction is first of its kind gathering together objects from private collections and items that belonged to the family which were sold by the state," Mihail Stomff, head of private sales at Artmark auction house told the Associated Press. "The value is foremost a historical one."

So what's on offer Thursday and at what price?

There's a carpet depicting the family of the dictator that should have had pride of place in the People's Palace, a giant building that now serves as Romania's Parliament and was inspired from a visit to North Korea in the 1971, that has a starting price of euro800 ($1,035), a swanky pen that will go under the hammer for at least euro2,000 ($2,585) which Ceausescu received during a visit to Japan in 1975, and an assortment of furs which will sell for at least euro1,200 ($1,555).

Among the more eccentric items is a bronze yak given to Ceausescu by China's Mao Tse-tung and or gold-plated silver and enameled doves that Ceausescu received from the Shah of Iran in 1977.

There are also Communist-era posters, medals, photos and flags, up to 70 years old, some extolling Lenin and Stalin. A Time magazine from 1948 has Ana Pauker, a Romanian Communist Party leader on the front cover.

Some of the objects were initially auctioned in by the state organization charged with dealing with the dictator's goods and came back on the market through private owners.

Fascination with the former Romanian leader his lavish lifestyle is nothing new, but Thursday's sale is the first public sale of Ceausescu memorabilia in a decade.

In the past, auctioneers have offered custom-made sports utility vehicles which were used by the Ceausescu couple, and even pajamas which were snapped up, with unsold items donated to an old people's home.

Buyers from Japan, the U.S. and Britain have been among those that bought the dictator's memorabilia, and foreigners still appear to be fascinated with Ceausescu.

"The posters are superb. They reflect an era," said a Canadian buyer late Wednesday, who declined to give his name. "It will be interesting to see the profile of buyers tomorrow."

Iran Strait Of Hormuz Conflict: Lawmakers Step Up Threats To Close Key Oil Route

TEHRAN, Iran ? Two Iranian lawmakers on Monday stepped up threats their country would shutter the strategic Strait of Hormuz, through which a fifth of the world's crude flows, in retaliation for oil sanctions on Tehran.

The warnings came as EU nations agreed in Brussels on an oil embargo against Iran as part of sanctions over the country's controversial nuclear program. The measure includes an immediate embargo on new contracts for Iranian crude and petroleum products while existing ones are allowed to run until July.

Iran has repeatedly warned it would choke off the strait if sanctions affect its oil sales, and two lawmakers ratcheted up the rhetoric on Monday.

Lawmaker Mohammad Ismail Kowsari, deputy head of Iran's influential committee on national security, said the strait "would definitely be closed if the sale of Iranian oil is violated in any way."

Kowsari claimed that in case of the strait's closure, the U.S. and its allies would not be able to reopen the route, and warned America not to attempt any "military adventurism."

Another senior lawmaker, Heshmatollah Falahatpisheh, said Iran has the right to shutter Hormuz in retaliation for oil sanctions and that the closure was increasingly probable, according to the semiofficial Mehr news agency.

"In case of threat, the closure of the Strait of Hormuz is one of Iran's rights," Falahatpisheh said. "So far, Iran has not used this privilege."

Monday's EU measure also includes a freeze on the assets of Iran's central bank as part of sanctions meant to pressure Tehran to resume talks on its uranium enrichment, a process that can lead to making nuclear weapons. Iran insists its nuclear program is exclusively for peaceful purposes.

For its part, the United States has enacted, but not yet put into force, sanctions targeting Iran's central bank and, by extension, the country's ability to be paid for its oil.

Some 80 percent of Iran's oil revenue comes from exports and any measures or sanctions taken that affect its ability to export oil could hit hard at its economy. With about 4 million barrels per day, Iran is the second largest producer in OPEC.

Tensions over the strait and the potential impact on global oil supplies and also the price of crude have weighed heavily on consumers and traders. Both the U.S. and Britain have warned Iran over any disruption to the world's oil supply through he strait.

Another Iranian lawmaker, Ali Adyani, sought to downplay the latest EU move, describing it as a "mere propaganda gesture," according to the semiofficial Fars news agency.

Former intelligence minister, Ali Falahaian, suggested Iran should stop all its crude exports "so that oil prices would go up and the Europeans' sanctions would collapse."

Threats to close the strait escalated during Iran's naval exercises in the Persian Gulf in January. Iran plans more naval war games in February.

(AP) ? Joe Paterno, the longtime Penn State coach who won more games than anyone in major college football but was fired amid a child sex abuse scandal that scarred his reputation for winning with integrity, died Sunday. He was 85.

His family released a statement Sunday morning to announce his death: "His loss leaves a void in our lives that will never be filled."

"He died as he lived," the statement said. "He fought hard until the end, stayed positive, thought only of others and constantly reminded everyone of how blessed his life had been. His ambitions were far reaching, but he never believed he had to leave this Happy Valley to achieve them. He was a man devoted to his family, his university, his players and his community."

Paterno built his program on the credo "Success with Honor," and he found both. The man known as "JoePa" won 409 games and took the Nittany Lions to 37 bowl games and two national championships. More than 250 of the players he coached went on to the National Football League.

"He will go down as the greatest football coach in the history of the game," Ohio State coach Urban Meyer said after his former team, the Florida Gators, beat Penn State 37-24 in the 2011 Outback Bowl.

Paterno's son Scott said on Nov. 18 that his father was being treated for lung cancer. The cancer was diagnosed during a follow-up visit for a bronchial illness. A few weeks after that revelation, Paterno also broke his pelvis after a fall but did not need surgery.

Paterno had been in the hospital since Jan. 13 for observation for what his family had called minor complications from his cancer treatments. Not long before that, he conducted his only interview since losing his job, with The Washington Post. Paterno was described as frail then, speaking mostly in a whisper and wearing a wig. The second half of the two-day interview was conducted at his bedside.

"As the last 61 years have shown, Joe made an incredible impact," said the statement from the family. "That impact has been felt and appreciated by our family in the form of thousands of letters and well wishes along with countless acts of kindness from people whose lives he touched. It is evident also in the thousands of successful student athletes who have gone on to multiply that impact as they spread out across the country."

The final days of Paterno's Penn State career were easily the toughest in his 61 years with the university and 46 seasons as head football coach.

It was because Paterno was a such a sainted figure ? more memorable than any of his players and one of the best-known coaches in all of sports ? that his downfall was so startling. During one breathtaking week in early November, Paterno was engulfed by a scandal and forced from his job, because he failed to go to the police in 2002 when told that a young boy was molested inside the university football complex.

"I didn't know which way to go ... and rather than get in there and make a mistake," he said in the Post interview.

Jerry Sandusky, the former defensive coordinator expected to succeed Paterno before retiring in 1999, was charged with sexually assaulting 10 boys over 15 years. Two university officials stepped down after they were charged with perjury following a grand jury investigation of Sandusky. But attention quickly focused on an alleged rape that took place in a shower in the football building, witnessed by Mike McQueary, a graduate assistant at the time.

McQueary testified that he had seen Sandusky attacking the child and that he had told Paterno, who waited a day before alerting school authorities. Police were never called and the state's top cop later said Paterno failed to execute his moral responsibility by not contacting police.

"You know, (McQueary) didn't want to get specific," Paterno said in the Post interview. "And to be frank with you I don't know that it would have done any good, because I never heard of, of, rape and a man. So I just did what I thought was best. I talked to people that I thought would be, if there was a problem, that would be following up on it."

On the morning of Nov. 9, Paterno said he would retire following the 2011 season. He also said he was "absolutely devastated" by the abuse case.

"This is a tragedy," the coach said. "It is one of the great sorrows of my life. With the benefit of hindsight, I wish I had done more."

But the university trustees faced a crisis, and in an emergency meeting that night, they fired Paterno, effective immediately. Graham Spanier, one of the longest-serving university presidents in the U.S., also was dismissed.

According to Lanny Davis, an attorney retained by the trustees as an adviser, board vice chairman John Surma regretted having to tell Paterno the decision over the phone.

The university handed the football team to one of Paterno's assistants, Tom Bradley, who said Paterno "will go down in history as one of the greatest men, who maybe most of you know as a great football coach."

Thick, smoky-lens glasses, rolled up khakis, jet-black sneakers, blue windbreaker ? Paterno was easy to spot on the sidelines. His teams were just as easy to spot on the field; their white helmets and classic blue and white uniforms had the same old-school look as the coach.

Paterno believed success was not measured entirely on the field. From his idealistic early days, he had implemented what he called a "grand experiment" ? to graduate more players while maintaining success on the field.

He was a frequent speaker on ethics in sports, a conscience for a world often infiltrated by scandal and shady characters.

His teams consistently ranked among the best in the Big Ten conference for graduating players. As of 2011, it had 49 academic All-Americans, the third-highest among schools in the Football Bowl Subdivision. All but two played under Paterno.

"He teaches us about really just growing up and being a man," former linebacker Paul Posluszny, now with the NFL's Jacksonville Jaguars, once said. "Besides the football, he's preparing us to be good men in life."

Paterno certainly had detractors, as well. One former Penn State professor called his high-minded words on academics a farce. He was criticized for making broad critiques about the wrongs in college football without providing specifics. A former administrator said his players often got special treatment compared to non-athletes. His coaching style often was considered too conservative. Some thought he held on to his job too long. There was a push to move him out in 2004 but it failed.

But the critics were in the minority, and his program was never cited for major violations by the college football's governing body. However, the child sexual abuse scandal prompted separate investigations by the U.S. Department of Education and the National Collegiate Athletic Association into the school's handling.

Paterno played quarterback and cornerback for Brown University and set a defensive record with 14 career interceptions, a distinction he boasted about to his teams all the way into his 80s. He graduated in 1950 with plans to go to law school. He said his father hoped he would someday be president.

When he was 23, a former coach at Brown was moving to Penn State to become the head coach and persuaded Paterno to come with him as an assistant.

"I had no intention to coach when I got out of Brown," Paterno said in 2007 at Beaver Stadium in an interview before being inducted into the Hall of Fame. "Come to this hick town? From Brooklyn?"

In 1963, he was offered a job by the late Al Davis ? $18,000, triple his salary at Penn State, plus a car to become general manager and coach of the American Football League's Oakland Raiders. He said no. Rip Engle retired as Penn State head coach three years later, and Paterno took over.

At the time, the Lions were considered "Eastern football" ? inferior ? and Paterno courted newspaper coverage to raise the team's profile. In 1967, PSU began a 30-0-1 streak.

But Penn State couldn't get to the top of the polls. The Lions finished second in 1968 and 1969 despite perfect records. They went 12-0 in 1973 and finished fifth. Texas edged them in 1969 after President Richard Nixon, impressed with the Longhorns' bowl performance, declared them No. 1.

"I'd like to know," Paterno said later, "how could the president know so little about Watergate in 1973, and so much about college football in 1969?"

A national title finally came in 1982, in a 27-23 win over Georgia at the Sugar Bowl. Penn State won another title in 1986 after the Lions picked off Vinny Testaverde five times and beat Miami 14-10 in the Fiesta Bowl.

They have made several title runs since then, including a 2005 run to the Orange Bowl and an 11-1 campaign in 2008 that earned them a berth in the Rose Bowl, where they lost 37-23 to Southern California.

In his later years, physical ailments wore the old coach down. Paterno was run over on the sideline during a game at Wisconsin in November 2006 and underwent knee surgery. He hurt his hip in 2008 demonstrating an onside kick.

An intestinal illness and a bad reaction to antibiotics prescribed for dental work slowed him for most of the 2010 season. Paterno began scaling back his speaking engagements that year, ending his summer caravan of speeches to alumni across the state.

Then a receiver bowled over Paterno at practice in August, sending him to the hospital with shoulder and pelvis injuries and consigning him to coach much of the season from the press box.

"The fact that we've won a lot of games is that the good Lord kept me healthy, not because I'm better than anybody else," Paterno said two days before he won his 409th game and passed Eddie Robinson of Grambling State for the most in Division I. "It's because I've been around a lot longer than anybody else."

Paterno could be conservative on the field, especially in big games, relying on the tried-and-true formula of defense, the running game and field position.

"They've been playing great defense for 45 years," Iowa coach Kirk Ferentz said in November.

Paterno and his wife, Sue, raised five children in State College. Anybody could telephone him at his modest ranch home ? the same one he appeared in front of on the night he was fired ? by looking up "Paterno, Joseph V." in the phone book.

He walked to home games and was greeted and wished good luck by fans on the street. Former players paraded through his living room for the chance to say hello. But for the most part, he stayed out of the spotlight.

He could be abrasive and stubborn, and had his share of run-ins with his bosses or administrators. And as his legend grew, so did the attention to his on-field decisions, and the questions about when he would retire.

Calls for his retirement reached a crescendo in 2004. The next year, Penn State went 11-1 and won the Big Ten. In the Orange Bowl, PSU beat Florida State, whose coach, Bobby Bowden, left the Seminoles after the 2009 season after 34 years and 389 wins.

Like many others, he was outlasted by "JoePa."

(AP) ? Joe Paterno would no doubt have made a dramatic courtroom witness. But legal experts said his death will have little or no effect on the criminal or civil cases to come out of the Penn State child sex-abuse scandal.

"Obviously, you're taking away a great deal of the high-profile nature of this case, because it deals with Joe Paterno's football program," said Jeffrey Lindy, a criminal defense lawyer involved in a clergy-abuse case in Philadelphia. "But with regard to the legal impact of his death, there is none."

Paterno died Sunday at 85, two months after former coaching assistant Jerry Sandusky was charged with molesting boys and two university officials were accused of perjury and failing to report child sex-abuse allegations against Sandusky to police.

The criminal case against the two university officials may even become more streamlined without Paterno in the mix.

Former university vice president Gary Schultz and athletic director Tim Curley are charged with failing to report to police what graduate assistant Mike McQueary said he told them in 2002: that McQueary saw Sandusky sexually assaulting a boy in a locker room shower.

McQueary first told Paterno, who said he reported it to Curley and Schultz the next day. The administrators told the grand jury they were never informed that the allegations were sexual in nature.

With Paterno's death, though, a jury is free to focus not on what Paterno knew or did, but on the defendants' actions.

What McQueary told Paterno "was a distraction, and now that that part of the case is really gone, it will focus much more on his interaction not with Paterno, but with the Penn State officials," said Duquesne University law professor Nicholas P. Cafardi.

McQueary is also the more crucial witness in the case against Sandusky, who is charged with abusing 10 boys, at least two of them on the Penn State campus.

Paterno testified for just seven minutes last January before the grand jury. He gave only vague answers ? and was never pressed ? when asked what he knew about anyone accusing Sandusky of molesting boys.

"Without getting into any graphic detail, what did Mr. McQueary tell you he had seen and where?" Paterno was asked, according to the grand jury testimony read in court last month.

"Well, he had seen a person, an older ? not an older, but a mature person who was fondling, whatever you might call it ? I'm not sure what the term would be ? a young boy," Paterno replied.

He was asked if he ever heard of any other allegations against Sandusky, who had been the subject of a lengthy campus police investigation four years earlier after a mother complained Sandusky had showered with her young son at the football complex.

"I do not know of anything else that Jerry would be involved in of that nature, no. I do not know of it," Paterno said, adding, "You did mention ? I think you said something about a rumor. It may have been discussed in my presence, something else about somebody. I don't know."

Paterno's grand jury testimony cannot be used in court, because the defense never had the chance to cross-examine him.

"His passing deprives folks from finding out, directly from his lips, exactly what he knew and when he knew it, and what he did or didn't do. But the reality is, sometimes those things can be proved by other means," said Jeff Anderson, the St. Paul, Minn., lawyer who filed the first civil case against Penn State on behalf of a Sandusky accuser.

It's not unusual for a witness to die or become infirm before trial, especially in child sex-abuse cases, which can take years or even decades to surface. In Philadelphia, prosecutors won the right to question 88-year-old retired Cardinal Anthony Bevilacqua on video last year to preserve his testimony before the spring trial of three priests and a church official. Bevilacqua suffers from dementia and cancer.

Prosecutors never got the chance to preserve Paterno's testimony, given his surprise cancer diagnosis and rapid decline after they filed the charges Nov. 4.

Roy Speckhardt: Let's Stop Voting in Churches

Think about the last time you voted. Was it in a school? A government building? What about a church? It's only intuitive that where you vote, and what's visible in the polling location, impacts how you vote. That's why there is a political line 75 to 100 feet or more from the polling place over which ads for various campaigns and parties must not cross. It would be an unfair advantage, and possibly even intimidating, for campaigns to advertise any closer. It's no different with religious messages, many of which have real political consequences. So it's time to stop voting in churches, which are hardly neutral grounds for the issues of the day.

A Baylor University study just published in the International Journal for the Psychology of Religion found that having a church in clear sight can influence people's answers to questions. Co-author Wade Rowatt pointed out that the "important finding here is that people near a religious building reported slightly but significantly more conservative social and political attitudes than similar people near a government building." The Baylor study confirms an earlier Stanford University study that shows the same effect when looking specifically at how people's voting place influences their vote. Stanford researcher Jonah Berger said, "Voting in a church could activate norms of following church doctrine. Such effects may even occur outside an individual's awareness." A follow-up study in the laboratory asked participants to vote on several issues after being shown images of specific voting places. This showed that participants were less likely to support a stem-cell initiative if they were shown church images than if they were shown school images or a generic photo of a building.

Psychologically, this phenomenon is known as "priming," where what you are initially exposed to goes on to impact your responses or decisions afterward. It's a well-researched effect and explains what is happening in the polling places. So the studies covering this issue are sound and their conclusions make sense: where you vote matters.

Since polling place influences the vote, governments and election boards should do all they can to find neutral voting locations. And it would seem very unlikely that churches would be chosen if neutrality were the aim. Why not use schools, courthouses, firehouses and the like instead? It's been argued that some places exist where the church is the most convenient, and that may be true in certain exceptional rural areas, but that's no justification for the many thousands of churches used in some thirty percent of polling places today.

When connecting with American Humanist Association members, examples of clear-cut cases of abuse abounds. An Illinois member voted in a church that displayed a four-foot wooden crucifix right above the election judges. Another member in California was confronted with a large marble plaque dedicated to the "unborn children" who are "killed" by abortion and containing a quote from the Bible justifying the notion that the soul is alive in the womb. And a New York member voted in a room featuring large religious slogans on the wall behind the voting machines. Sure there are some churches that utilize gymnasiums carefully cleaned of religious paraphernalia, but even those places have the power to inappropriately influence the vote. Let's move the vote exclusively to public buildings.

Prosecutors: 4th man recruited in NYC bomb plot (AP)

NEW YORK ? Federal prosecutors have quietly added a new wrinkle to their case against a New York City man charged in one of the most serious terror plots since the Sept. 11 attacks.

In a revised indictment filed last week in Brooklyn, Adis Medunjanin was hit with a new allegation that he ? along with former high school classmates Najibullah Zazi and Zarein Ahmedzay ? tried to recruit someone identified only as John Doe to travel to Pakistan "to wage violent jihad."

It was the first time the government has linked a fourth person in the U.S. to what evolved into an al-Qaida-sanctioned scheme to pull off what prosecutors call three "coordinated suicide bombing attacks" on Manhattan subway lines. Lawyers for Medunjanin are now demanding that the government reveal the identity of the man before he turns up as a possible witness at a trial set for March.

"We want to know who John Doe is," defense attorney Robert Gottlieb said Thursday.

A pretrial hearing is scheduled next week to take up the issue. The defense also plans to oppose a request by prosecutors for an anonymous jury, Gottlieb said.

A spokesman for the U.S. attorney's office in Brooklyn declined to comment Thursday.

Medunjanin, 27, has pleaded not guilty to conspiring to use weapons of mass destruction, providing material support to a terrorist organization and other charges.

Prosecutors allege that Medunjanin, Zazi and Ahmedzay tried to recruit the fourth man before the three went to Afghanistan in 2008 to join the Taliban and fight U.S. soldiers. They instead were recruited by al-Qaida operatives, who gave them weapons training in their Pakistan camp and asked them to become suicide bombers, authorities say.

The new indictment doesn't say what became of the fourth man.

After returning, Zazi, a former Denver airport shuttle driver, cooked up explosives and set out for New York City around the eighth anniversary of the 9/11 attacks. After becoming suspicious he was being watched by law enforcement, he abandoned the plan and returned to Colorado.

Zazi and Ahmedzay have since admitted in guilty pleas that they wanted to avenge U.S. aggression in the Arab world by becoming martyrs. Both could testify against Medunjanin at trial.

China says government to be more open (AP)

BEIJING ? China says it will be more open about the often secretive workings of the government and ruling Communist Party.

However, senior propaganda official Wang Chen said Wednesday that strict controls over the Internet would remain in place.

Wang said China will open up more by expanding the use of government spokespeople, expanding the overseas reach of state media, and refining the use of microblogs to interact with the public.

China polices the web rigorously to block pornographic or politically sensitive information, as well as blocking major social networking sites such as Facebook and Twitter.

WiFi adapter stopped functioning in new Windows installation

Hi,

Could anyone help with this problem, please? I have just changed my operating system from 32-bit Windows XP Pro SP3 to 64-bit Windows 7 Professional. Since doing this my WiFi adapter has ceased to function.

It is an Edimax EW-7711In PCI card and I have downloaded new drivers which the Edimax web site says will drive the card in 64-bit Windows. They won't. As the chipset is made by Ralink, I have also downloaded files from their web site for the Ralink3060 chip which don't work either.

The machine is a dual boot machine with Ubuntu as the other operating system and when I boot into Ubuntu I am able to use the card, which shows that it is not damaged and ought to work.

How can I resolve this problem? I have tried installing the software by running it as administrator but that has made no difference. In device manager the card shows up as a grey outline and the message with it says that the driver is not installed. The programs that I have downloaded from the two web sites say that the driver is installed

I would be grateful for any help before I revert back to Windows XP!

Canon EOS 300 cinema cam gets pre-order status, ships at month's end for $16,000

Back in November we joined Martin Scorsese and other Hollywood luminaries at Paramount Studios for the unveiling of Canon's latest cinema video camera, which is now available for pre-order. The EOS C300, that aims to compete directly against the Reds of the world, carries a Super 35mm CMOS sensor capable of up to 4K resolution 1080p capture, and should be helped in large part by the company's top-shelf lenses; like the 14.5 - 60mm and 30 - 300mm. When we first met the C300 we told you it'd be priced at a hefty $20,000, but that's no longer the case, instead it'll cost a less painful $16,000 for the body only. The camera will begin shipping "after January 30th," and if it seems like a little too much for you, at least you can still watch our precious hands-on time with it.

Update: We've updated to clarify that while the sensor is 4K the camera only captures in 1080p.

Planck space telescope warms up as planned

ScienceDaily (Jan. 18, 2012) ? The High Frequency Instrument aboard the Planck space telescope has completed its survey of the remnant light from the Big Bang explosion that created our universe. The sensor ran out of coolant on Jan. 14, as expected, ending its ability to detect this faint energy.

"The High Frequency Instrument has reached the end of its observing life, but the Low Frequency Instrument will continue observing for another year, and analysis of data from both instruments is still in the early phase," said Charles Lawrence, the U.S. Planck project scientist at NASA's Jet Propulsion Laboratory in Pasadena, Calif. "The scientific payoff from the High Frequency Instrument's brilliantly successful operation is still to come."

NASA plays an important role in the Planck mission, which is led by the European Space Agency. In addition to helping with the analysis of the data, NASA contributed several key components to the mission itself. JPL built the state-of-the-art detectors that allowed the High Frequency Instrument to detect icy temperatures down to nearly absolute zero, the coldest temperature theoretically attainable.

Less than half a million years after the universe was created 13.7 billion years ago, the initial fireball cooled to temperatures of about 4,000 degrees Celsius (about 7,200 degrees Fahrenheit), releasing bright, visible light. As the universe has expanded, it has cooled dramatically, and its early light has faded and shifted to microwave wavelengths.

By studying patterns imprinted in that light today, scientists hope to understand the Big Bang and the very early universe, as it appeared long before galaxies and stars first formed.

Planck has been measuring these patterns by surveying the whole sky with its High Frequency Instrument and its Low Frequency Instrument. Combined, they give Planck unparalleled wavelength coverage and the ability to resolve faint details.

Launched in May 2009, the minimum requirement for success was for the spacecraft to complete two whole surveys of the sky. In the end, Planck worked perfectly in completing not two, but five whole-sky surveys with both instruments.

The Low Frequency Instrument will continue surveying the sky for a large part of 2012, providing data to improve the quality of the final results. The first results on the Big Bang and very early universe will not come for another year.
